Community Guidelines

Bio-Invasion is a global community of people who record observations of invasive species and share them with each other so all of us can learn more about the natural invasive world. These guidelines are not a replacement for our Term of Use.

Suspendable Offenses :

The following behaviors lead to immediate suspension without warning.

Hate speech. Hate speech is content consciously designed to attack people based on age, race, gender, sexual orientation, income, physical ability, country of origin, religion, educational background, or any other attribute that people are unable to control.

Insults or threats. Insults are attacks meant purely to belittle or offend people. A threat is any content that indicates an intent to harm another person. Note that warnings about suspension or other regulatory actions on the part of site staff on Bio-Invasion are not threats.

Sexually explicit content. Observations of mating non-human species are fine, but common sense should still be used.

Sockpuppet accounts. A sockpuppet account is an additional account set up to evade suspension, circumvent restrictions in functionality, or other forms of bad behavior, like confirming your own identifications. This does not include multiple accounts set up for multiple roles, e.g. a personal account and a professional account.

Accepted behavior :

Images of dead or dismembered animals. While we do not endorse killing or fatally injuring animals just for the sake of contributing to Bio-Invasion, as naturalists we understand that invasive species must be eradicated as they can be a serious threat to local species, biodiversity, health, food or human infrastructures. While these kinds of images can be disturbing for some people, they can also be interesting, and provide the same kind of scientifically relevant occurrence data as an image of a living creature. Very often they demonstrate some aspect of the life history of the organisms involved.

Tools for Dealing With Problems:

Abuse report. Observations with inappropriate content can be reported as an abuse by any user and will be suspended immediately from the website.

Blocking. Blocking is an extreme measure for situations where efforts to resolve differences through discussion have failed and the offending party refuses to stop contacting you. Blocking someone will prevent them from interacting with you on Bio-Invasion. If you feel you need to block someone, please contact info@bio-invasion.com and we will consider your request. If we (the site staff) find that you are using blocking to silence identifiers you don’t trust, we will investigate and we may suspend you.

info@bio-invasion.com. If there is a serious problem that you can't resolve or there are people on the site who cannot abide by these guidelines despite numerous requests to change their behavior, please email us and we will investigate and possibly suspend such people.

Terms of use

Welcome to the Bio-Invasion website ("Bio-Invasion" or the "Website"). The following Terms of use govern all use of the Bio-Invasion website, iOS App and Android App, the Bio-Invasion Network Member Websites, API, and all content, services and products available at or through the websites and apps (collectively, the "Website"). The Website is owned and operated by the PermanentLife Association. The Website is offered subject to Your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, the Bio-Invasion Privacy Policy and procedures that may be published from time to time on this Site by Bio-Invasion and the PermanentLife Association (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the Website, each user ("You", "Your" or "User") agrees to the terms and conditions of this Agreement. If You do not agree to all the terms and conditions of this Agreement, You should not access the Website or use any services made available via the Website. The Website is available only to individuals who are at least 13 years old, unless parental permission has been obtained.

Your Bio-Invasion Account and Site. If You create an account on the Website, You are responsible for maintaining the security of Your account, and You are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not post content to Your account in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others. Bio-Invasion may, at its discretion, change or remove any content that it considers inappropriate or unlawful. You must immediately notify Bio-Invasion of any unauthorized uses of Your account or any other breaches of security. Bio-Invasion will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

2.
Responsibility of Contributors. If You post material to the Website, or otherwise make (or allow any third party to make) material available by means of the Website (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, You represent and warrant that:

- the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;

- the Content is not spam and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);

- You will post only Content that is relevant to Bio-Invasion and at a rate and volume that does not hinder other Users' ability to use Bio-Invasion;

- the Content is not libelous or defamatory, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;

- Your account details do not mislead others into thinking they represent another specific person or organization (unique pseudonyms are allowed). For example, Your login name is not the name of a person other than Yourself or company other than Your own;

- Your content is not getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, journals and web sites, and similar unsolicited promotional methods.

By submitting Content to Bio-Invasion for inclusion on the Website, You grant Bio-Invasion a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish the Content solely for the purpose of displaying, distributing, and promoting Your observations and journal via Bio-Invasion. We might also use the Content for other purposes not subject to known legal restrictions, such as training machine learning models. You represent and warrant that (a) You own and control all of the rights to the Content that You post or You otherwise have the right to post such Content to the Site; (b) the Content is accurate and not misleading; and (c) use and posting of the Content You supply does not violate these Terms of Use and will not violate any rights of or cause injury to any person or entity. If You delete Content, Bio-Invasion will use reasonable efforts to remove it from the Website, but You acknowledge that caching or references to the Content may not be made unavailable immediately.

Without limiting any of those representations or warranties, Bio-Invasion has the right (though not the obligation), in Bio-Invasion’s sole discretion, to terminate or deny access to and use of the Website to any individual or entity for any reason.

3.
Responsibility of Website Visitors. Bio-Invasion has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Bio-Invasion does not represent or imply that it endorses the material posted to the Website, or that it believes such material to be accurate, useful, non-infringing or non-harmful. You are responsible for taking precautions as necessary to protect Yourself and Your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Bio-Invasion disclaims any responsibility for any harm resulting from the use by visitors of the Website, any mislabeling by Website visitors of observations, or from any downloading by those visitors of content posted to the Website.

Non-Commercial Use. You agree not to use the Website, the Bio-Invasion Service, or any Bio-Invasion Content for commercial purpose or for any illegal, unlawful, inappropriate, or unauthorized purpose or activity. You further agree not to threaten, abuse, solicit, spam, harass, stalk, impersonate or intimidate other Bio-Invasion Users and not to collect or store any location or other personal information about any Bio-Invasion Users that You obtain from the Website, except for non-commercial research, conservation, and species management purposes.

Copyright Infringement and DMCA Policy. Bio-Invasion respects the intellectual property rights of others, and requests that Users of the Bio-Invasion Website and Service do the same.

If You believe that Your work has been copied on the Website in a way that constitutes copyright infringement, please provide Bio-Invasion's Copyright Agent with the information specified below in the form of a “Notification of Alleged Infringement.” It is Bio-Invasion's policy to respond to clear Notifications of Alleged Infringement, and our policy is designed to make submitting Notifications of Alleged Infringement as straightforward as possible while reducing the number of Notifications that we receive that are fraudulent or difficult to understand or verify. If You are concerned about the removal of or blocked access to Your content, please provide Bio-Invasion's Copyright Agent with a “Counter-Notification.” The process specified below is consistent with that provided under the Swiss Federal Act on Copyright and Neighbouring Rights of October 9, 1992 (NFACN) (the text of which can be found at the Fedlex Website at https://www.fedlex.admin.ch).

Bio-Invasion will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of Bio-Invasion or others, Bio-Invasion may, in its discretion, terminate or deny access to and use of the Website.

6.
Intellectual Property. All trademarks, service marks, graphics and logos used in connection with Bio-Invasion or the Website are trademarks or registered trademarks of Bio-Invasion, PermanentLife association or Bio-Invasion’s Users or other third parties. Your use of the Website grants You no right or license to reproduce or otherwise use any Bio-Invasion or third-party trademarks. This Agreement does not transfer to You any Bio-Invasion or third party intellectual property, and all right, title and interest in and to such property will remain solely with Bio-Invasion or such owners.

7.
Changes. Bio-Invasion reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is Your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Bio-Invasion may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

8.
Termination. Bio-Invasion may terminate Your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If You wish to terminate this Agreement or Your Bio-Invasion account, You may simply discontinue using the Website and delete Your account. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties. The Website is provided “as is.” Bio-Invasion and its suppliers and Members hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Bio-Invasion nor its suppliers or Members makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that You download from, or otherwise obtain content or services through, the Website at Your own discretion and risk.

10.
Limitation of Liability. In no event will Bio-Invasion be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; or (iii) for interruption of use or loss or corruption of data. Bio-Invasion shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

11.
General Representation and Warranty. You represent and warrant that (i) Your use of the Website will be in strict accordance with the Bio-Invasion Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in Your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the Switzerland or the country in which You reside) and (ii) Your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

12.
Indemnification. You agree to indemnify and hold harmless Bio-Invasion, the PermanentLife association, their contractors, licensors and Members, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of Your use of the Website, including but not limited to Your violation this Agreement.

13.
Miscellaneous. This Agreement constitutes the entire agreement between Bio-Invasion and You concerning the subject matter hereof, and may be modified only by a written amendment signed by an authorized executive of Bio-Invasion, Permanentlife Sàrl, or by the posting by Bio-Invasion of a revised version of these Terms of Use. Except to the extent applicable law, if any, provides otherwise, any access to or use of the Website will be governed by the laws of Switzerland, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts of Switzerland. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may not assign Your rights under this Agreement; Bio-Invasion may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

This is the privacy policy ("Privacy Policy") of the PermanentLife association and bio-invasion.com website, iOS App, and Android App, the Bio-Invasion Network Member Websites, and describes how bio-invasion.com ("Bio-Invasion," "We," "Us" or "Our") handles Personal Information (as defined below) that users ("You," "Your” or "User") provide to Us, or that We collect from You through the use of Our Website, which is located at www.bio-invasion.com) and through the Bio-Invasion Network Member websites (collectively, the "Websites"), and through the Bio-Invasion iOS App, and the Bio-Invasion Android App and the Seek by Bio-Invasion App (the “App(s)”).

Each country has different laws and rights relating to Personal Information of their residents. If You are a resident located outside Switzerland, in addition to this Privacy Policy, please also see Your country specific disclosures.

This Privacy Policy is subject to Our Terms of Use. We may update this Privacy Policy from time to time, as specified in the “Changes to This Privacy Policy” section below.

Your Consent

You should read this entire Privacy Policy before submitting information to Us or using Our Websites. Whenever You submit personal and non-personal information via Our Websites or otherwise to Us, whether online or offline, You consent to the collection, use disclosure, transfer, and storage of that information in accordance with this Privacy Policy.

Types of Information We Collect

"Personal Information" means information such as Your first/middle initial or name, last name, e-mail address, street address, mailing address if different, town or city, state, zip code, telephone number, profile photograph, Internet Protocol (IP) addresses, credit card information and any other information that could allow someone to identify You or contact You, including information collected through cookies and other technology.

Bio-Invasion collects Personal Information of the sort that web browsers, hardware, software and servers typically make available, such as the IP address, device ID, browser type, language preference, referring site, pages viewed, one or more cookies that may uniquely identify your browser, and the date and time of each visitor request. Bio-Invasion's purpose in collecting this information is to better understand how Bio-Invasion's visitors use its Websites and Apps. From time to time, Bio-Invasion may release such information in the aggregate, e.g., by publishing a report on trends in the usage of its Websites and Apps.

How We Collect Personal Information

Bio-Invasion may collect Personal Information when You choose to interact with Bio-Invasion in ways that require Bio-Invasion to gather such information, such as if You browse on Bio-Invasion, register as an Bio-Invasion User, update or add information to Your Bio-Invasion profile, provide content to Bio-Invasion through Your computer or phone, make a donation to Bio-Invasion through the Websites, make a purchase from the Bio-Invasion store (collectively, the Bio-Invasion "Services"), or otherwise communicate or engage with Us about the Bio-Invasion Services. When You post an Observation on Bio-Invasion, We may collect Your User ID, latitude and longitude of the site of the Observation, the place name of the site of the Observation, the date and time of the Observation, the metadata associated with image or sound files, the app You used to contribute data, and the time zone of the site of the Observation. The amount and type of information that Bio-Invasion gathers depends on the nature of the interaction. In each case, Bio-Invasion collects such information only insofar as is necessary or appropriate to fulfill the purpose of Your interaction with Bio-Invasion. Bio-Invasion does not disclose Personal Information other than as described herein. You can refuse to supply Personal Information, with the caveat that doing so may prevent You from engaging in certain Website and App-related activities, such as registering as an Bio-Invasion User, maintaining an Bio-Invasion profile, or posting content to Bio-Invasion. Without providing personal information (other than the automatic provision of Your IP address), You will still be able to access and use Bio-Invasion on a read-only basis.

How We Use Personal Information

We may use the Personal Information that You provide in order to deliver the Bio-Invasion Services and to administer and maintain the Bio-Invasion Websites, respond to Your inquiries, improve our services, business, and Websites, manage our business including spam detection and fraud prevention purposes, for marketing, legal and research purposes, and to understand how You use Our Websites and services. If You register as a Bio-Invasion User, You must give Us current, complete and accurate information and keep the information You provide to Us up to date. We cannot and shall not be responsible for any problems or liability that may arise if You do not give Us current, accurate, truthful, or complete information or if You fail to update the information You give Us.

When We Disclose and Share Personal Information

Personal Information You provide related to the Observations You post (user name, date, time, location) is published in venues on Bio-Invasion where it is visible to anyone ("Published") as matter of normal usage and therefore is publicly shared with other Bio-Invasion Users, whether or not they are signed in. We also explicitly and publicly share this information publicly in a machine-readable format with a handful of partners, including the Global Biodiversity Information Facility ("GBIF"). We share Personal Information associated with Users’ registration and account (IP address, email address, etc.) with representatives from Bio-Invasion Network Members (see https://www.Bio-Invasion.com for information about the Bio-Invasion Network). Bio-Invasion Network Members can request and receive Personal Information from Users who affiliate with their particular Member site as their primary site.

Bio-Invasion discloses Personal Information to contractors, service providers, consultants and affiliated organizations that (i) need to know that information in order to process it on Bio-Invasion's behalf or to provide Services available at Bio-Invasion's Websites and Apps, and (ii) that have agreed not to disclose it to others, with the exception of non-public location data from Observations for non-commercial research, conservation, and species management purposes.

Some of those contractors, service providers and affiliated organizations may be located outside of Your home country; by using Bio-Invasion's Websites or Apps, You consent to the transfer of such information to them. Bio-Invasion will not rent or sell Personal Information to anyone. We share your Personal information with entities that support Our business and operations such as hosting Our Websites and data, communicating with You, fraud and spam detection, data analytics, and other legitimate business purposes including communicating with the Apple App Store, the Google Play Store, Google Analytics, Google Firebase and New Relic.

We use OpenStreetMap (to display geographic content). If You choose to participate in some optional services, We will share Personal Information with entities that make those services possible.

Other than as described above, Bio-Invasion discloses Personal Information only when required to do so by law, or when Bio-Invasion believes in good faith that disclosure is reasonably necessary to protect the property or rights of Bio-Invasion, third parties, or the public at large. Unless authorized by You through Your opt-in, or as provided above, We will make Your Personal Information available to non-affiliated third parties only in the following circumstances:

• If We are compelled to do so by a governmental agency, court, or other entity (e.g., to respond to subpoenas, court orders or legal process);
• If We believe Your actions violate a law, regulation, this Privacy Policy, or any applicable website or app's terms of use, or if You threaten the rights, property or safety of Us, Our Websites, Our Apps, any other Users, or third party;
• If, in Our sole discretion, We believe disclosure is necessary to investigate or resolve possible problems or inquiries, to protect Our assets, to defend Our interests or comply with Our legal and regulatory obligations; or to protect a User's safety;
• If there is a bankruptcy, merger, acquisition, transfer of control, joint venture or other business combination involving Bio-Invasion.

If You are a registered User of Bio-Invasion and have supplied Your email address, Bio-Invasion may occasionally send You an email to tell You about new features, solicit Your feedback, or just keep You up to date with what's going on with Bio-Invasion and Our services. We primarily use blogs and groups to communicate this type of information, so We expect to keep this type of email to a minimum. If You send Us a request (for example via a support email or via one of Our feedback mechanisms), We reserve the right to publish it in order to help Us clarify or respond to Your request or to help Us support other Users. Bio-Invasion takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of Personal Information.

Legal Basis for Processing Personal Information Under the General Data Protection Regulation (GDPR)

If You are a resident of the European Economic Area (EEA), Bio-Invasion's legal basis for collecting and using the Personal Information described in this Privacy Policy depends on the Personal Information We collect and the specific context in which We collect it. In addition, We process Personal Information with the principle of data minimization in mind. This means that We limit ourselves to the minimum amount of personal information which is needed to achieve the particular purpose for which We process the Personal Information. Below are some examples of the purposes for which Personal Information may be processed.

Bio-Invasion may process Your Personal Information because:

• The processing is necessary to provide the services and features You have requested
• The processing is necessary to perform a contract with You
• The processing is necessary for the legitimate interests of Our business, such as fraud prevention, information security, or to comply with the law
• You have provided consent for Us to do so.

Contact Preferences; Opt-In and Opt-Out

We would like to keep in touch with You in ways that You find to be beneficial. You can control the kinds of emails You receive after creating an account. Should You require assistance, You may contact Us directly by emailing info@bio-invasion.com. Keep in mind that these preferences regarding promotional contacts do not mean that We might not contact You for other reasons, such as those related to an inquiry You made, a legally required notice and so on.

How We Retain Personal Information

We retain Your Personal Information associated with Your registration for so long as You remain a registered User of Bio-Invasion. In addition, We may retain Personal Information from closed accounts to comply with national laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce Our User Agreement and take other actions permitted or required by applicable national laws.

Personal information associated with Observations (time, date, location, etc.) may remain attached to Observations, even after You have closed Your account unless You request that We delete it.

Children

We do not knowingly collect or solicit Personal Information from children or knowingly allow children to make purchases through Our Websites and Apps. Visitors 14 years of age and younger must obtain an adult's permission before submitting any Personal Information to our Websites or Apps. In the event that We learn that We have received any Personal Information from a visitor 14 years of age or younger, and We do not receive parental permission within a reasonable period of time of Our request for it, We will delete that information as quickly as possible. If You believe that We might have Personal Information from or about a child 14 years of age or younger, please contact Us at info@bio-invasion.com.

Cookies

Automated technology collects information from Your computer or mobile device and includes cookies, web beacons, local shared objects, or other similar technology. As You access or use Our Website, We and/or third parties may collect information using cookies, web beacons, pixels, navigational and location data collection (clickstream, log files, server logs) and other similar technologies for the purposes described in this Policy. Bio-Invasion uses cookies to help Bio-Invasion identify and track visitors, their usage of the Bio-Invasion Websites and their Website access preferences. Bio-Invasion visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Bio-Invasion's Websites. Certain features of Bio-Invasion's Websites, such as the ability to post Observations, may not function properly without the aid of cookies.

Third Party Analytics Disclaimer

We and/or third-parties and service providers on Our behalf, use cookies, web beacons and other similar technology, to collect information for the purposes described in this Policy including analytics, monitoring performance and improvement of Our online services (traffic, errors, page load time, popular pages, etc.).

Analytics

Google Analytics. We use Google Analytics to understand how Our website, services, and products perform, how You use them, and to serve You with ads on third-party websites.

How We Protect Your Personal Information

We are committed to protecting the Personal Information You share with Us through the use of Bio-Invasion and We maintain reasonable physical, electronic and procedural safeguards to protect Your Personal Information. We limit access to Personal Information by Our own employees to individuals who are authorized for the proper handling of such information and any employee found violating Our standards of security and confidentiality is subject to Our disciplinary processes. We request Our service providers to follow the same policy. Unfortunately, We cannot guarantee that data transmitted over the Internet will always be secure. As a result, although We strive to protect Your Personal Information, We cannot ensure or warrant the security of any information You transmit or We may learn as a result of Your use of Bio-Invasion and You do so at Your own risk. If, for any reason, You do not agree with this Privacy Policy, please do not use or attempt to take advantage of any of the information, services, features or functions of Bio-Invasion that might require You to provide Your Personal Information.

Your Rights with Your Personal Information

If You are a resident of the European Economic Area (“EEA”), You have certain rights with regard to Your Personal Information. Those include:

• The right to access, update or delete the information We have about You. In many instances, You can personally access and update Your Personal Information by accessing Your online account settings when logged in.
